What it is
When both spouses agree and there is no dispute between them, a divorce in Georgia can be registered administratively by the Public Service Development Agency. We help you check whether your situation fits this route, prepare the documents and, where permitted, act through a representative.
Under Article 1123 of the Civil Code, if there is a dispute between the spouses, the divorce must be obtained through court proceedings; in other cases it is registered by the civil registration authority. In practice, that authority is the Public Service Development Agency (PSDA).
In the administrative route, the spouses file a joint written application with their identity documents and the marriage certificate. The PSDA registers the divorce five working days after the application is filed. The fee for registration and the certificate is GEL 60.
A spouse may also apply alone in specific cases listed by the PSDA — for example on the basis of a court judgment on divorce, or where the other spouse has been declared missing by a court or sentenced to at least three years' imprisonment, subject to further conditions.
Who this is for
- Spouses who agree on the divorce and have no dispute.
- Spouses living abroad who wish to act through a representative.
- People who are unsure whether their situation needs a court.
How we help
- Assessing whether the administrative route is available.
- Preparing the joint application and documents.
- Accompaniment at the Public Service Hall.
- Preparing and translating a power of attorney if you will not attend in person.
- Referral to a qualified family lawyer if court proceedings are needed.
How it works
- 1
Assessment
Do you both agree, and is there any dispute — for example about children, support or property?
- 2
Documents
Identity documents, the marriage certificate and, if needed, a duly certified power of attorney.
- 3
Application
The joint application is filed at a PSDA territorial office or Public Service Hall.
- 4
Registration
The divorce is registered five working days after filing, and the certificate is issued.
Details and documents
Documents
For a joint application (PSDA):
- A joint written application of the spouses.
- Identity documents of both spouses.
- The marriage certificate.
- If filed through a representative: a duly certified power of attorney and the representative's identity document.
Foreign documents may need an apostille or legalisation and a notarised Georgian translation.
In person or remotely
The PSDA accepts applications filed through a representative with a duly certified power of attorney. Whether this suits you depends on where and how the power of attorney can be certified.
Important to know
- Not every divorce can be registered administratively. If the spouses disagree, a court must decide.
- During the wife's pregnancy and for one year after the birth of a child, the husband may not file for divorce without the wife's consent (Civil Code, Article 1123).
- In court, the judge may adjourn the hearing for up to six months to allow reconciliation (Civil Code, Article 1127).
- Whether a marriage registered abroad can be dissolved through the Georgian administrative procedure must be checked individually.
- We do not give conclusions on contested family-law questions — custody, support or division of property — without the facts and a qualified lawyer's review.
What to prepare for a consultation
- Where and when the marriage was registered.
- Whether you both agree and whether there are common minor children.
- Whether both of you can attend in person.
- Where you will use the divorce certificate.
